Welcome to the Global.health website (the “Site”). Please read these  terms of use (the “Terms of Use”) carefully before using the Site, making a contribution to the Site, or otherwise accessing or downloading any information from the Site. The Terms of Use constitute a binding agreement between You and Boston Children’s Hospital (“We”, “Us”, “Our”, “Boston Children’s” or “BCH”), and govern Your access and use of the Site, which includes any information, data, tools, visualizations, products, services and other content (together, “Content”) available on or through the Site.

BY ACCESSING OR USING THE SITE IN ANY WAY, INCLUDING WITHOUT LIMITATION, BROWSING THE SITE, USING ANY INFORMATION, OR SUBMITTING ANY CONTENT OR PERSONAL INFORMATION VIA THE SITE, YOU AS THE USER (“YOU”) AGREE TO AND ARE BOUND BY THE TERMS, CONDITIONS, POLICIES, AND NOTICES CONTAINED IN THESE TERMS OF USE, INCLUDING CONDUCTING THIS TRANSACTION ELECTRONICALLY, CERTAIN THIRD PARTY TERMS AND CONDITIONS, DISCLAIMERS OF WARRANTIES, DAMAGE AND REMEDY EXCLUSIONS AND LIMITATIONS, VENUE SELECTION, AND A CHOICE OF MASSACHUSETTS LAW. YOU REPRESENT AND WARRANT THAT YOU ARE AT LEAST EIGHTEEN (18) YEARS OLD OR OLDER AND POSSESS THE LEGAL RIGHT AND ABILITY TO AGREE TO THESE TERMS OF USE.

The Site is a resource to help advance the understanding of infectious disease cases for purposes of aiding research analyses, infectious disease surveillance, epidemic modeling, and data visualizations.  The Site contains data and resources from sources from across the world. Boston Children’s does not endorse nor are we responsible for any data or Content available from such sources.

We may collect Your personal information when You access or use the Site. For more information about the information we collect in connection with Your use of the Site and how we may use such information, please refer to our Privacy Policy.

 

 

  1. Boston Children’s grants You a limited right to use the Site.

The Site is owned and operated by Boston Children’s. Subject to these Terms of Use, We grant to You, for Your personal, public health and/or non-commercial research use only, a nonexclusive, limited, and revocable right to access and use the Site. All Content available through the Site may be accessed, downloaded, or printed for noncommercial personal, public health and/or scientific purposes only and solely within the scope allowed by these Terms of Use. Some Content is available to logged in users or users with certain privileges only. Unauthorized individuals, institutions and other entities may not act on behalf of Boston Children’s, use its property or solicit contributions without express authorization from Boston Children’s.

  1. User Conduct

By using the Site, including any Content available through the Site, You agree that You shall not:

(a) delete, modify, block, overwrite, hack or attempt to change or alter any of the Content;

(b) use any Content for the purpose of monitoring any individual(s) or making any decision or assessment impacting the rights or freedoms of any individual(s), including without limitation to harm others, their careers, business prospects or eligibility for services, benefits, insurance or programs;

(c) re-identify or attempt to re-identify any individual;

(d) attempt to access accounts, computer systems, devices, or networks connected to any of Our servers or to the Site, through hacking, password mining, or any other means, or obtain or attempt to obtain any materials or information through any means not intentionally or readily made available through the Site;

(e) use any device, software or routine intended to damage or otherwise interfere with the proper functioning of the Site or servers, devices, or networks connected to the Site, or availability of Content to other users, or take any other action that interferes with other parties’ use of the Site or Content;

(f) use any robot, spider or other automatic or manual device or process for the purpose of harvesting or compiling information on the Site for purposes other than for a generally available search engine or as otherwise expressly permitted by these Terms of Use or within the Site where such information collection is limited to Content and is for personal, public health and/or non-commercial research purposes and is subject in each instance to these Terms of Use and any additional terms provided by Boston Children’s applicable to such means of access;

(g) use any Boston Children’s names, service marks, or trademarks, or logos without Our prior written consent, including without limitation as metatags, search engine keywords, or hidden text;

(h) use any Content, which is made available through the Site, in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary or other right of any party;

(i) transmit or upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage or interfere with the operation of another’s computer or property;

(j) create a false identity, including for the purpose of misleading others, breach any contractual or confidentiality obligations, or violate the privacy rights of others;

(k) defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of any third party;

(l) provide false information, impersonate another person or entity, or misrepresent Your affiliation with any entity;

(m) use any Content in a manner that is discriminatory, abusive, harassing, insulting, misleading, deceptive or defamatory or for any unlawful purpose or in connection with or in furtherance of any violation of law, regulation or judicial order;

(n) commercialize access to or use of the Site or Content;

(o) impose an unreasonable or disproportionately large administrative burden on Boston Children’s or otherwise interfere with, undermine, impair or damage the databases, infrastructure, servers, interfaces or networks related to or connected to the Site or Content; or

(p) encourage or enable any other person or party to do any of the foregoing.

You shall notify Us immediately upon the discovery of any breach of this Section 2.

  1. You grant Boston Children’s a right to use Your contributions.

To the extent available to You, You may be granted privileges to make contributions to the Site and Content. By submitting any contribution to the Site, You grant to Boston Children’s a perpetual, royalty-free, sublicenseable, transferrable, unconditional worldwide right and license to use, display and publish Your contribution on the Site and all affiliated sites and services, as well as disseminate, distribute and share it to other parties via RSS or other media, and to discuss or reference it in whole or  in part in any publications related to or arising out of Global.health and free of any payment, royalty, or other compensation of any kind to me. You also agree that Boston Children’s has the right, but not the obligation, to edit or remove any contribution, create derivatives thereof, or to merge it in text or concept with other contributions, in Boston Children’s sole discretion.

We will credit Your contribution by publishing it with Your name or an acceptable pseudonym of Your choosing, or You may remain anonymous. You understand that the Site is an open resource with Content and resources freely available, and therefore Your contribution may be openly accessible and available.

Boston Children’s and Our users, including government agencies, depend on independent third-party contributors for the accuracy of submissions. Boston Children’s does not endorse nor is responsible for any data or Content available from such contributors or errors or inaccuracies in any submission. Deliberate misrepresentation of information by a contributor may constitute a violation of law, and We may report such violations to appropriate government authorities.

If Boston Children’s receives any notification that any submission you make through the Site is inappropriate, infringes or violates any rights of any third party, or if Boston Children’s wishes to remove your submission for any reason whatsoever, Boston Children’s reserves the right to automatically remove such submission for any reason immediately or within such other timescales as may be decided from time to time by Boston Children’s in its sole discretion. The submission shall be taken down without any admission as to liability and without prejudice to any rights, remedies or defenses, all of which are expressly reserved. You acknowledge and agree that Boston Children’s is under no obligation to put back such submission at any time.

  1. You will be bound by revised versions of the Terms of Use that Boston Children’s posts on the Site.

Boston Children’s may, at any time and from time to time, amend these Terms of Use. Any modifications to the Terms of Use will be effective immediately upon posting unless We indicate otherwise. You agree to review the Terms of Use periodically, and Your use of the Site indicates Your full acceptance of these Terms of Use in then-current form each time You use the Site. If You object to any provision of these Terms of Use or any subsequent modifications to these Terms of Use, Your only recourse is to immediately terminate use of the Site.

  1. Applicable International Privacy Laws.

By accessing and/or downloading any Content, You agree to comply with all applicable laws and regulations including applicable international laws, regulations and directives regarding privacy.

Boston Children’s makes no representation that any Content is appropriate or available for use outside the United States, its territories, possessions and protectorates. If You choose to access the Site from other locations, You do so on Your own initiative and at Your own risk. You are responsible for complying with local laws, if and to the extent local laws are applicable. You specifically agree to comply with all applicable laws concerning the transmission of technical data exported from the United States or the country You reside in.

  1. The Content is owned by Boston Children’s, its affiliates and/or third parties.

Global.health, Boston Children’s Hospital, any associated logos, and all Boston Children’s registered or unregistered trademarks are the property of Boston Children’s. All other trademarks, service marks, trade names and logos appearing on the Site are the property of their respective owners. All Content contained in the Site is the property of Boston Children’s, its licensors or its content contributors, and is protected by U.S. and international copyright and trademark laws. The compilation (meaning the collection, arrangement and assembly) of all Content on the Site is the exclusive property of Boston Children’s and is protected by U.S. and international copyright laws. Certain Content, namely information about infection cases, is obtained from publicly available third-party information, data and content. Such data remains the property of our respective data sources for such Content and is made available as part of the Content in accordance with such third-party data licensor’s license terms for their data, as applicable.   

The Content on the Site may be used for informational, public health and non-commercial research purposes only and in accordance with these Terms of Use. The Content may not in any way be abstracted, reproduced or translated, regardless of whether or not all copyright, trademark and other proprietary notices are included in each such use, except as permitted by using the data download feature as intended (and not circumventing the download feature to copy or reproduce data) and in accordance with these Terms of Use, including the attribution requirements set forth in the “Acknowledgments and Third Party Rights” section below. No portion of the Site or the Content may be sold or otherwise used or distributed in conjunction with any commercial purpose, unless expressly permitted in writing by Boston Children’s.

Systematic retrieval of Content from the Site, including, without limitation, by using any data mining, crawlers, spiders, robots, or similar methods, to create or compile, directly or indirectly, a collection, compilation, database or directory is strictly prohibited without prior written permission from Boston Children’s in each instance or as otherwise expressly permitted by these Terms of Use or within the Site where such information collection is limited to Content and is for personal, public health and/or non-commercial research purposes and is subject in each instance to these Terms of Use and any additional terms provided by Boston Children’s applicable to such means of access.  

Neither these Terms of Service nor Your use of the Site transfers any right, title or interest in the Site, the Content, or Intellectual Property Rights to You.

  1. Boston Children’s is not liable for any actions taken in reliance of the Content on the Site.

To the extent permissible under applicable laws, Boston Children’s expressly disclaims all responsibility for any injury and/or damage to persons or property as a matter of products liability, negligence or otherwise, or from any use or operation of any Content, ideas, instructions, methods, products or procedures contained in the Site. IN NO EVENT WILL BOSTON CHILDREN’S, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, SUBCONTRACTORS, AGENTS, LICENSORS AND REPRESENTATIVES BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BY YOU IN RELIANCE ON SUCH CONTENT. The additional disclaimers included in the various publications available via the Site are hereby incorporated by reference.

  1. Boston Children’s is not responsible for any technological problems or any impact that they may have.

All or any portion of the Site may not be available and may not function properly at any time. We make reasonable efforts to avoid technological problems, but at any time the Site may have and may cause technological problems such as viruses and other damaging computer programming routines or engines. We take reasonable security precautions when using the internet, telephone or other means to transport data or other communications, but We disclaim liability for any interception of data or communications. We make reasonable efforts to ensure that the Site is secure but We do not guarantee the security of the Site. Any transmission is at your own risk.

  1. Boston Children’s is not responsible for information provided by third parties or on any third-party web site that is referred in, or accessible or connected by hyperlink to, the Site.

The Site includes third party-owned and supplied content, including without limitation data, resources and submissions made available by third parties, and may also include hypertext links to third party-owned web sites. We have no control over any third-party owned web sites or content referenced, accessed by or available through the Site and the provision via the Site of links and referrals to other web sites, publications or information resources does not constitute the endorsement of those web sites or resources by Boston Children’s, Global.health, its agents or representatives. All third-party content is provided “as is”, and Boston Children’s makes no representations, warranties or claims as to the quality, content and accuracy of the information, services or products which may be provided by such resources. IN PARTICULAR, BOSTON CHILDREN’S DISCLAIMS ANY LIABILITY ARISING OUT OF OR RELATED TO ANY THIRD-PARTY CONTENT REFERENCED OR LINKED THROUGH THE SITE, INCLUDING, WITHOUT LIMITATION, ANY ALLEGATION THAT THIRD PARTY CONTENT OR SERVICES INFRINGES OR VIOLATES THE INTELLECTUAL PROPERTY, PRIVACY OR PROPRIETARY RIGHTS OF ANY PERSON, AND DISCLAIMS ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

The Site and all Content, materials, information and services are provided on an “as is,” “as available” and “with all faults” basis. Boston Children’s and its licensors and suppliers disclaim all representations and warranties, express or implied, of any kind of respect to the Site and materials and Content contained in the Site, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement of intellectual property and proprietary rights. Except as specifically labeled otherwise, data accessed by or through the Site (“Global.health Data”) is licensed under Creative Commons Attribution 4.0 International by the Boston Children’s Hospital.

You may use Global.health Data to author, co-author or publish results, observations and/or insights obtained from your analyses of relevant Global.health Data, provided that any such published results, observations or insights acknowledge (1) the original source of such Global.health Data, (2) the publication: Xu, B., Gutierrez, B., Mekaru, S. et al.   1. You will be responsible for any liability to Global.health and/or Boston Children’s that arises out of Your breach of these Terms of Use or Your use of the Site.

You hereby agree to indemnify, defend and hold Global.health, Boston Children’s and its affiliates and subcontractors, and their respective directors, officers, employees, affiliates, agents, licensors and representatives, harmless from and against any and all suits, liability, losses, damages, costs, and expenses (including reasonable attorneys’ fees) that arise from or relate to:

  1. Your use of the Site or any Content or Global.health Data therein;
  2. Your breach of Your obligations under the Terms of Use or any representation, warranty or covenant made by You in the Terms of Use;
  3. Your violation of any applicable law, statute, ordinance, regulation or of any third party’s rights; or
  4. claims asserted by third parties which, if proven, would place You in breach of the representations, warranties, covenants or other provisions contained in the Terms of Use.
 
  1. Miscellaneous

These Terms of Use and Your use of this Site and Content are, and shall be governed and construed in accordance with, the internal laws of the Commonwealth of Massachusetts, without regard to its rules concerning conflict of laws. In the event of any conflict between foreign laws, rules and regulations and those of the United States and/or other country, the laws, rules and regulations of the United States or other country shall govern. The parties agree that exclusive jurisdiction and venue for any claims will be in the state or federal courts located in Boston, Massachusetts, U.S.A.

It is Boston Children’s policy to comply with all applicable laws and regulations as they may be modified from time to time. In the event that any provision of this Terms of Use may be in conflict with any applicable law or regulation, the applicable law or regulation will supersede the conflicting provision.

You agree that any claim or cause of action arising out of Your use of the Site or Content or these Terms of Use must be filed within one (1) year after such claim or cause of action arose or it shall forever be barred, notwithstanding any statute of limitations or other law to the contrary. Within this period, any failure by Boston Children’s to enforce or exercise any provision of these Terms of Use or related right shall not constitute a waiver of that right or provision.

If any provision in these Terms of Use is found by a court or arbitrator to be invalid, the parties agree that the court or arbitrator should give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms of Use will remain in full force and effect.

The United States export control laws regulate the export and re-export of technology originating in the United States. This includes the electronic transmission of information and software to foreign countries and to certain foreign nationals. You agree to abide by these laws and regulations.

Boston Children’s failure to act with respect to a breach by any visitor using the Site does not constitute a waiver of its right to act with respect to subsequent or similar breaches.

Boston Children’s may assign its rights and duties under these Terms of Use without notice to You.
